In accordance with the 《 Pharmacy and Poisons Ordinance 》, it is because electronic cigarette contains nicotine ( nicotine is classified as Part I Poison ) and is claimed to be a kind of smoking cessation product, it is therefore classified as a pharmaceutical product which must be registered before sale. The possession or sale of unregistered pharmaceutical product, and the possession of Part I poison without permission, are both liable on conviction to a HK$100,000 fine and 2 years’ imprisonment.
