 Prevention of the Use on Heat-not-Burn (HnB) Tobacco Products

The Tobacco Control Legislation (Amendment) Bill 2025 has been passed by the Legislative Council. The following measures will be implemented by phases upon gazettal of the Tobacco Control Legislation (Amendment) Ordinance 2025.

Measures Effective Date
Prohibition of giving smoking products (including conventional smoking products and alternative smoking products) to persons under the age of 18 years 19 September 2025 (i.e., upon gazettal of the Ordinance)
Increase penalties for duty-not-paid tobacco
Require cigarettes sold at a price lower than the tobacco duty be proved to be duty-paid
Implementation of a duty stamp system for cigarettes Pilot in early October 2025
Full implementation in the second quarter of 2027
Ban on smoking while queuing 1 January 2026
Expansion of Statutory No Smoking Areas to within 3 metres from entrances/exits of specific premises
Fixed penalty for smoking offences increases from $1,500 to $3,000
Prohibition of possession of ASP substances
(e.g. e-cigarette oil/ capsules/heat sticks) in public places
30 April 2026
Implement plain packaging requirements Second quarter of 2027 on par with the duty-stamp system
Ban on flavoured conventional smoking products After implementation of duty-stamp system and plain packaging requirements (i.e. after the second quarter of 2027).
